Exhibition Terms and Conditions

1. Creation, Title. The artist warrants that the artist created and possesses unencumbered title to the works of art exhibited and has the right to loan the works for purposes of exhibition and the right to sell the work if listed for sale.

2. Delivery, Condition. The artist is responsible for arranging to have the works delivered to ReachArts.  All costs of delivery (including transportation and insurance) is paid by the artist. The artist is solely responsible for noting any condition issues.

3. Loss or Damage of Work. ReachArts is not responsible for any loss or damage to the work or personal property of the artist. The artist agrees to hold ReachArts harmless and blameless for the loss of, or any and all damage to, the work while in possession of ReachArts. Artist is responsible for insuring the Work.

4. Installation. The artist shall deliver each work ready for display unless a special installation is required.

5. Copyright, Reproduction. The artist reserves all reproduction rights, including the right to claim statutory copyright, on the work, provided that ReachArts may reproduce the work for its catalog of the exhibition and related promotion.  

6. Termination of Right to Exhibit.  The artist or ReachArts may terminate the right to exhibit any work by written notice at any time and for any reason.

7. Work for Sale by Artist. ReachArts may arrange sales of any of the work, unless the work is expressly indicated by the artist as not for sale. All sales of work as a result of the exhibition are charged by ReachArts a commission of 30% of sales prices.
   
   

Venue Terms and Conditions

In consideration of ReachArts allowing a user (“User”) to have use of or access to any of ReachArts facilities, and for other good and valuable consideration, the User agrees as follows:

1. Loss or Damage. ReachArts is not responsible for any loss or injury a) to personal property, or b) to User or any guests or invitees of User. The User shall hold ReachArts harmless and blameless for any loss or injury c) to personal property, or d) suffered by the User or any guests or invitees of User. User is responsible for insuring the artwork or other property of User at the ReachArts premises.

2. Heirs and Assigns. This Agreement shall be binding upon the User, his or her heirs, successors, assigns, and personal representatives, and references to the Usershall include his or her heirs,successors, assigns, and personal representatives.

3. Integration. This Agreement constitutes the entire understanding regarding the foregoing, and can be modified only by an instrument in writing signed by both User and ReachArts.

4. Waivers. A waiver of any breach of any of the provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same or other provisions hereof.

5. GoverningLaw. This Agreement shall be governed by the laws of the State of Massachusetts.
   
   

Town Sign Artwork Terms and Conditions

1. ReachArts reserves the right to use images of artwork for promotional purposes

2. ReachArts and the Town Administrator selects the artwork. Images of the artwork not displayed may be reserved for display during the next 6 month period.

3. ReachArts is not responsible for loss, theft or damage

4. Exhibitors are responsible for their own insurance while their work is located at ReachArts, displayed, and in transit.

Art On The Walls Terms and Conditions

1. ReachArts reserves the right to use images of artwork for promotional purpose.
2. ReachArts selects and hangs the artwork.  Artwork to be gallery ready/framed and ready to display.
3. Reach Arts reserves the right to move the artwork should that area of the building be temporarily used for an alternative purpose.
4. All artwork will be openly displayed in the building, in areas open to the public. ReachArts is not responsible for loss, theft or damage.
5. Exhibitors are responsible for their own insurance while their work is located at ReachArts and in transit.
   
   

Made by 01907 Terms of Sale

ReachArts provides a marketplace for buyers to purchase from sellers participating in the Made by 01907 online event. By shopping in the Made by 01907 event, you are not buying directly from ReachArts, but from one of the 21 sellers at the event. ReachArts is assisting sellers by processing orders on their behalf. ReachArts does not guarantee any item provided by sellers. ReachArts has a designated delivery time frame however each seller is responsible for their own processing times, shipping packaging, and exchange and return policies. All sales are final on the ReachArts website. If there is a problem with your order or item, please contact ReachArts at info@reacharts.org within 48 hours of receiving the item. ReachArts will connect you directly with the artist to address the problem. 

To purchase an item during the Made by 01907 online event:

• Please be sure to read the item description and check the price before making a purchase;
• Submit appropriate payment for your purchase;
• Provide accurate contact, delivery/pick up and/or shipping information; and
• Double check your contact information and make sure that your payment processed. 

By completing your purchase you automatically agree to the ReachArts’ Terms of Sale.
Our services are provided “as is” and without any kind of warranty (express or implied). ReachArts expressly disclaims any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade. ReachArts does not guarantee that all products will be available, or any defects or errors will be corrected. Shopping at the Made by 01907 online event is at your own risk.
ReachArts liability is limited to the fullest extent of the law. Neither ReachArts, its volunteers or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special or punitive damages arising out of or in connection with the Made by 01907 event. In no event shall ReachArts’ aggregate liability for any damages exceed the lesser of $50 USD or the amount you paid ReachArts for product or services in the past twelve months. 

Some jurisdictions do not allow limitations on implied warranties, incidental or consequential damages, so the above limitations may not apply to you. These Terms of Sale are governed by the laws of the Commonwealth of Massachusetts without regard to its conflict of laws rules.

Terms of Raffles

To make the Made by 01907 event even more fun, all purchasers age 18+ are entered into a raffle connected to the time of purchase. The number of entries provided for each individual purchase will be based on increments of $20. All purchases will be eligible for at least one entry. Additional raffle entries will be awarded for each additional $20 spent during a designated time block. No purchase is required to enter the raffles. Follow these directions for entry:

1. Send an email with your name, email address and phone number to raffle@reacharts.org.
2. You will be entered into the raffle for the time slot in which your email is received.

The raffle winners will be determined by a random drawing which will occur on or before December 1, 2020. Raffle items are provided by local businesses and ReachArts makes no representations and assumes no liability with respect to such items or the use thereof.
